Notice of Decision

NOTICE OF THE PASSAGE OF AN APPLICATION FOR

A ZONING BY-LAW AMENDMENT FOR A SITE SPECIFIC EXCEPTION

TAKE NOTICE THAT the Council of the Corporation of the Town of Penetanguishene passed By-law 2019-23 on April 10, 2019 under Section 34 of the Planning Act, R.S.O. 1990. By-law 2019-23 pertains to the property at 45 Edward Street (formerly part of 31 Lucy Street) in the Town of Penetanguishene.  A Location Map has been provided illustrating the lands affected by the amendment.

THE PURPOSE AND EFFECT of the Zoning By-law Amendment adds as an additional use a “Cancer Support Centre” and decreases the required building setback from the Interior Side Yard from 4.5 metres to 1.5 metres. Additionally, the exception reduces the parking area setbacks from the required 7.5 metres in the Front Yard and Exterior Side Yard to 5.7 metres and 3.0 metres respectfully. The effect of the application permits the construction of a new Institutional building, specifically a “Cancer Support Centre”, having a reduce Interior Side Yard setback and to permit a parking area with reduced setbacks.

CORRESPONDENCE RECEIVED from the public and external agencies on the proposed amendment were summarized and included in Staff Report PL-2019-14 for the Public Meeting on March 13, 2019. Comments received at or after the public meeting were summarized and considered in the preparation of the final Zoning By-law and were included in Staff Report PL-2019-15 for the Committee of the Whole meeting on March 27, 2019.

EFFECT OF WRITTEN AND ORAL SUBMISSIONS

In accordance with Subsection 34(10.10) of the Planning Act, R.S.O. 1990, the written and/or oral submissions received had the following effect on the decision:

  • The written and oral submissions received by Council and were considered in coming to their decision and that the comments had been addressed in the supporting reports and studies. Council determined that the proposed Zoning By-law Amendment was consistent with the Provincial Policies, the County of Simcoe Official Plan and the Town’s Official Plan.

AND TAKE NOTICE that an appeal to the Local Planning Appeal Tribunal (LPAT) in respect of the By-law may be made by filing with the Clerk a Notice of Appeal setting out the objection to the By-law and the reasons in support of the objection no later than the Tuesday, May 7, 2019. The appeal must be accompanied by the fee of $300.00 required by the Local Planning Appeal Tribunal and must be payable to the Minister of Finance.

EXPLANATORY NOTE TO BY-LAW 2019-23

THE PURPOSE AND EFFECT of the Zoning By-law Amendment:

The amendment to Zoning By-law 2000-02, as amended, will allow a new institutional use a “Cancer Support Centre” to be permitted on the property. The exception will include special setbacks for the building from the interior side yard (east side of the property) and for the parking area (on the west and south side of the property).
