Notice Regarding Zoning By-law 2000-02 and Temporary Structures

NOTICE OF PUBLIC MEETING CONCERNING A

PROPOSED ZONING BY-LAW AMENDMENT

TAKE NOTICE THAT pursuant to Section 34 of the Planning Act, R.S.O. 1990, the Council of the Corporation of the Town of Penetanguishene will hold a Public Meeting on Wednesday, June 13, 2018 at 7:00 p.m. in the Council Chambers, Townhall, 10 Robert Street West, Penetanguishene to consider a proposed Zoning By-law Amendment.

The proposed Zoning By-law Amendment (Z.A. 2/2018) relates to ALL LANDS within the Town of Penetanguishene.  As the proposed amendment affects the entire municipality no Location Map has been provided.

THE PURPOSE AND EFFECT of the rezoning is to consider an amendment to the General Provisions Section of the Zoning By-law 2000-02, regarding “Temporary Structures”.  Currently, “Temporary Structures” are regulated under Section 3.22 Accessory Buildings, Uses and Structures which does not differentiate between permanent Buildings and Temporary Structures.  The Town is considering changes to the Zoning By-law to separate “Temporary Structures” from Section 3.22 Accessory Buildings, Uses and Structures and to create new regulations for “Temporary Structures”.  The proposed amendment would include a new definition of a “Temporary Structures” and new performance standards regarding the location of Temporary Structures.  The effect of amendment would provide new regulations for “Temporary Structures” on all properties within the Town.

ANY PERSON MAY attend the public meeting and make oral or written representation either in support of, or in opposition to, the proposed Zoning By-law Amendment.  If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Penetanguishene before a zoning by-law amendment is passed, the person or public body is not entitled to appeal the decision of the Council of the Town of Penetanguishene to the Local Planning Appeal Tribunal.  Also, if a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Penetanguishene before a by-law amendment is passed the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

ADDITIONAL INFORMATION regarding the proposed amendment is available to the public for inspection at the Penetanguishene Municipal Office between 8:30 a.m. and 4:30 p.m. Monday to Friday.

Dated at the Town of Penetanguishene this 24th day of May, 2018.
