Notice of Passing of Development Charges By-Law by The Corporation of The Town of Penetanguishene

TAKE NOTICE that on Wednesday, August 14, 2024 the Council of The Corporation of the Town of Penetanguishene passed By-law No. 2024-33 under Section 2 of the Development Charges Act, 1997, which imposes Town-wide development charge rates.

AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal under Section 14 of the Act, in respect of the Development Charges By-law, by filing with the Deputy Clerk of the Town of Penetanguishene on or before Monday, September 23rd, 2024 a notice of appeal setting out the objection to the By-law and the reasons supporting the objection. Appeals filed with the Deputy Clerk at 10 Robert St W, Penetanguishene ON L9M 2G2, will be accepted on or before Monday, September 23rd, 2024. A processing fee will be payable to the Town of Penetanguishene with the appeal application. The appellant is advised to contact the Ontario Land Tribunal to access required forms and applicable fees.

The charges in the aforementioned by-law will apply to all new residential and non-residential development, subject to certain terms, conditions and limited exemptions as identified therein. Development charges are levied against new development to pay for the increased capital costs related to the provision of such Town services as Development-Related Studies, Library Board, Fire Services, Parks & Recreation, Services Related to a Highway, Stormwater Management & Control, Sewer and Water. Schedule 1 below sets out the development charge rates applicable throughout the geographic boundary of the Town of Penetanguishene and therefore a map has not been provided.

Both the residential and non-residential development charge rates are in effect as of September 1, 2024. Copies of the by-law can be viewed and downloaded at the Town of Penetanguishene website at www.penetanguishene.ca or via the link above. The complete development charges by-law can also be examined at the Town Office from 8:30 am to 4:30 pm, Monday through Friday at the address shown below.
